1. Introduction
HHmetrics is a service operated by Maquila360, S. de R.L. de C.V. (“we”, “us”, “our”, or “HHmetrics”), a company registered in Mexico.
These Terms and Conditions (“Terms”) govern your access to and use of the HHmetrics website at hhmetrics.com and all related services (the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement.
2. Service Description
HHmetrics provides aggregated, anonymized population-level poker statistics for educational and analytical purposes. The data is derived from real poker hands and is presented to help users study population tendencies across various stakes and game scenarios.
The Service consists of two main features: Population Data, which provides pre-built analytics from our proprietary database of hundreds of millions of hands; and Hand Lab, which allows users to upload their own hand history files for personalized population analysis.
The Service does not facilitate, promote, or enable gambling or real-money poker play. HHmetrics is strictly an educational and analytical tool.
3. Account
To access certain features of the Service, you must create an account. You agree to:
— Provide accurate and complete registration information
— Maintain the security of your account credentials
— Notify us immediately of any unauthorized use of your account
— Accept responsibility for all activity that occurs under your account
Each person is entitled to one account only. Account sharing is strictly prohibited. You may not sell, transfer, or otherwise provide access to your account to any third party. We reserve the right to suspend or terminate accounts that violate this policy, without refund.
4. Plans and Pricing
HHmetrics is offered as a subscription with three plans: Small Stakes, Mid Stakes and High Stakes. Every plan includes Population Data, the Hand Lab and Top Players, for the stakes covered by the plan. A limited free tier is available.
All prices are displayed in United States Dollars (USD). Prices are subject to change at any time.
Data updates released while your subscription is active are included at no additional cost.
5. Subscriptions
The Hand Lab allows you to upload your own poker hand history files for personalized analysis. It is included in every plan.
Subscription fees are charged monthly or yearly via our payment provider. You may cancel your subscription at any time. Upon cancellation:
— Your databases are kept for 90 days after cancellation. Resubscribe within that period and you pick up exactly where you left off.
— After 90 days, your databases are deleted.
— On a Free account, your databases are deleted after 90 days without activity.
You may delete individual databases at any time through the platform. Deleted data cannot be recovered. Every plan lets you upload up to 5 million hands, spread over as many databases as you like. The stakes you can study depend on your plan. Free accounts get 1 database of up to 10,000 hands.
6. Changing Plans
A higher plan takes effect immediately, and you pay only the prorated difference. A lower plan takes effect at the end of your current billing period; until then, you keep your current plan. On the same plan, switching to annual billing takes effect immediately, with the same prorated difference, and switching to monthly billing takes effect at the end of your current billing period. A scheduled change can be cancelled from My plans before it takes effect. When a change leaves paid time unused, its value is credited to your next invoices; credits are not paid out.
7. Refund Policy
All purchases are final. No refunds are provided. HHmetrics is a digital product that grants immediate access to proprietary data upon purchase. A free tier is available for you to evaluate the platform before subscribing.
Subscriptions may be cancelled at any time but are not refundable for the current billing period.
8. User-Uploaded Data
When you upload hand history files to Hand Lab, you represent and warrant that you have the right to use and upload those files. You retain ownership of your uploaded data. You grant HHmetrics a limited, non-exclusive license to store and process your uploads to provide the service, and to use aggregated, anonymized data to operate and improve our services.
Your uploads are transmitted over an encrypted connection. Your databases are private to your account: no other user can see them, or the player names in your files.
9. Intellectual Property
All content available through the Service — including but not limited to statistics, data, analysis, board texture breakdowns, range distributions, bet sizing data, user interface design, and documentation — is the exclusive property of HHmetrics and is protected by applicable intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the data for your personal poker study only. You may not:
— Redistribute, resell, sublicense, or share the data with any third party
— Scrape, systematically download, or copy data from the Service
— Use automated tools, bots, or scripts to access the Service
— Create derivative products, databases, or services based on our data
— Share screenshots, exports, or data publicly in a manner that substitutes for the Service
Violation of this section may result in immediate account termination without refund, and we reserve the right to pursue any available legal remedies.
To enforce this section, we monitor how each account uses the Service, including the number and type of requests it makes. We may limit, suspend or terminate any account that shows automated or systematic downloading.
10. Acceptable Use
You agree not to:
— Use the Service for any unlawful purpose
— Attempt to interfere with, disrupt, or compromise the integrity of the Service
— Impersonate any person or entity, or misrepresent your affiliation with any person or entity
— Use the Service to develop, directly or indirectly, a competing product or service
— Attempt to gain unauthorized access to any part of the Service
11. Service Availability
We strive to maintain continuous availability of the Service, but we do not guarantee uninterrupted, timely, or error-free access. The Service may be temporarily unavailable due to maintenance, updates, technical issues, or circumstances beyond our control.
We reserve the right to modify, update, add, or remove features of the Service at any time, without prior notice. We will make reasonable efforts to communicate significant changes to users.
12. Data Accuracy
Population statistics presented on the Service are derived from real poker hands and are compiled in good faith. However, we make no warranty or representation that the data is complete, accurate, current, or free from errors.
The Service and all data are provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
13. Earnings Disclaimer
HHmetrics is an educational and analytical tool. We make no representations, warranties, or guarantees regarding potential poker earnings or results. Your outcomes depend on numerous factors including your skill level, bankroll management, game selection, opponent pool, and variance.
Past population data does not guarantee future results. Any examples, statistics, or data presented on the Service or in promotional materials are for illustrative purposes only and should not be interpreted as a promise or guarantee of earnings.
14. Limitation of Liability
To the maximum extent permitted by applicable law, HHmetrics and its operators, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, revenue, business opportunities, or goodwill, arising out of or in connection with your use of, or inability to use, the Service.
In no event shall our total aggregate liability to you for all claims arising from or related to the Service exceed the total amount you have paid to HHmetrics in the twelve (12) months immediately preceding the event giving rise to the claim.
15. Indemnification
You agree to indemnify, defend, and hold harmless HHmetrics and its operators, employees, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to your violation of these Terms, your use of the Service, or your violation of any rights of a third party.
16. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Termination for violation of these Terms does not entitle you to a refund.
You may close your account at any time by contacting us at contact@hhmetrics.com. Closing your account does not entitle you to a refund of any amounts previously paid.
17. Changes to These Terms
We reserve the right to modify these Terms at any time. The “Last updated” date at the top of this page indicates the most recent revision. We will make reasonable efforts to notify users of material changes. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms.
18. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Mexico, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Mexico.
